Six Steps for Efficient Case Analysis:
- Start by reading the decision first. It comes at the end of the case, but it allows you to anticipate the key parts of the law that would be best cited in your analysis.
- Review the abstract or the text that in italics at the beginning of the case study. This contains key terms that will help you gain a general overview of what happens.
- Everything after that before the numbered paragraphs is designed for context of the case. This part is insightful, but it is also opinion. The judge’s words enter at the numbered paragraphs.
- Since everything before the judge’s words are not law and were only written by an editor, they should not be cited. Only cite the words of the judge and the law itself.
- Read slowly using headings to orient yourself and look up words if you don’t understand them. This is important because you do not know what you are looking for or understand what is important when beginning.
- Finally, keep in mind what class you are taking since this will provide context about what laws to look for as you read.
